Abstract
Il contributo analizza l’evoluzione degli strumenti di programmazione negoziata nell’ordinamento amministrativo, con particolare riferimento alle figure iuris degli accordi di programma e dei patti territoriali. Premesse brevi note sul superamento della programmazione c.d. autoritativa e sulle trasformazioni del rapporto autorità-libertà, la riflessione approfondisce la disciplina giuridica dell’amministrazione per accordi nel contesto giuridico multilivello. L’analisi delle recenti innovazioni normative in materia di patti territoriali e di talune, e significative, esperienze applicative, evidenzia come tali strumenti rappresentino una risposta efficace alle sfide poste dalle più attuali “rivoluzioni” che investono il diritto e la società contemporanea, nella prospettiva di favorire – nell’ottica di quello che viene definito risultato amministrativo – il perseguimento degli obiettivi di sviluppo sostenibile dei territori e delle relative comunità.
Inter-institutional strategic planning and consensual approach to territorial development
This paper analyzes the evolution of negotiated programming instruments within the multilevel administrative legal order, regarding the legal figures of program agreements and territorial pacts. Following brief preliminary observations on the superseding of so-called authoritative programming and the transformations in the authority-liberty relationship, the reflection examines in depth the legal discipline of administration by agreement within the European, national, and regional legal context. The analysis of recent normative innovations concerning territorial pacts and certain significant practical experiences demonstrates how such instruments represent an effective response to the challenges posed by the most current “revolutions” affecting law and contemporary society, with a view to promoting – in the perspective of what is defined as administrative outcome – the pursuit of sustainable development objectives for territories and their respective communities.
