Abstract
Il contributo intende offrire una ricostruzione della procreazione medicalmente assistita, alla luce delle interpretazioni fornite dal Comitato Nazionale per la Bioetica (CNB). Partendo dall’analisi del binomio etica e diritto, nella prospettiva dell’evoluzione scientifica e della transizione tecnologica, lo scritto ripercorre le principali questioni che hanno interessato la PMA, laddove, al contempo, è emersa «[…] una fondamentale indecisione del CNB in una materia di tanta delicatezza e gravità». Nelle conclusioni, invece, si sottolinea la necessità di colmare i vuoti normativi, valorizzando il ruolo e l’expertise del CNB il quale ha, tra le altre, la finalità di «indicare soluzioni ai fini della predisposizione di atti legislativi».
The paper aims to offer a reconstruction of Medically Assisted Procreation, in the light of the interpretations provided by the National Committee for Bioethics (CNB). Starting from the analysis of the binomial ethics and law, in the perspective of scientific evolution and technological transition, the paper traces the main issues that have affected the PMA, where, at the same time, it has emerged «[…] a fundamental indecision of the C.N.B. in a matter of such delicacy and gravity». The conclusions, on the other hand, underline the need to fill the regulatory gaps, enhancing the role and expertise of the C.N.B. which has, among other things, the purpose of «indicating solutions for the purpose of preparing legislative acts»
