Abstract

“Agreement it’s not enough”. Reasoning about the principle of loyal collaboration between the State and the Regions in the perspective of differentiated regionalism

Abstract (eng): The article aims to highlight a profile, still unexplored, of the inadequacy of the reference to art. 8, paragraph 3, of the Constitution in relation to the proceduralization of the legislative approval of the agreement between the State and the Regions, necessary for the implementation of differentiated regionalism. This provision, in fact, brings with it the baggage of the related constitutional jurisprudence, which has established the political nature, therefore unquestionable, of the Government’s decision to start discussions in order to reach an agreement with non-Catholic confessions. The latter, on the other hand, in the context of differentiated regionalism should fit into the different structure that inspires Title V of the Constitution, within which the relations between the State and the Regions are characterized by the principle of loyal collaboration.
