Abstract

Revocation of the President of the City Council: evaluation of its features and legal boundaries

The Legislative Decree no. 267/2000 about local authorities does not directly mention the President of the Municipal Council’s revocation in particular. This work aims to trace the fundamental requirements for revocation’s power, its limits, and to identify which body of the public administration is legitimate to exercise this power. Besides, this work also evaluates the nature of the revocation power, based on the loss of “institutional trust” concerning omissions or defaults upon administrative duties. The power under analysis is linked to the choices of the council majority from which derives the need for safeguards in favor of the council minorities, rebalancing their power through the hypothesis of abuse of office.
