Abstract
La crescente consapevolezza della necessità di salvaguardare, tutelare e migliorare lo stato dell’ambiente e della salute collettiva, nonché di assicurare uno sviluppo sostenibile, ha condotto all’elaborazione di un articolato quadro giuridico multilivello in materia ambientale. In particolare, per quanto riguarda la qualità dell’aria, la sensibilità per la tematica si è espressa, a livello europeo, con l’adozione di piani e strumenti di soft law che hanno posto obiettivi ambiziosi. Sotto il profilo strettamente normativo, però, questi impegni programmatici non hanno sempre trovato un adeguato riscontro in disposizioni capaci di garantirne l’effettiva attuazione. Dopo le linee guida dell’OMS del 2021, non vi è più margine, sotto il profilo scientifico, per dubitare della pericolosità dell’inquinamento atmosferico per la salute umana e per l’ambiente. La scelta del legislatore europeo di non allinearsi alle indicazioni contenute nelle linee guida e individuare, invece, soglie diverse, solleva, dunque, interrogativi rilevanti in ordine all’effettiva idoneità di tali standard a garantire una protezione adeguata della salute pubblica e di assicurare il raggiungimento degli ambiziosi obiettivi del Green Deal Europeo.

Air quality: legal protection amid regulatory changes and sustainable development

The increasing recognition of the need to safeguard, protect, and enhance both environmental quality and public health, as well as to promote sustainable development, has led to the emergence of a complex, multi-level legal framework in the field of environmental protection. With regard to air quality, in particular, this growing awareness has been reflected at the European level through the adoption of plans and soft law instruments setting ambitious targets. From a strictly normative standpoint, however, such programmatic commitments have not always been matched by binding provisions capable of ensuring their effective implementation. Following the 2021 WHO guidelines, there is no longer any scientific basis to doubt the severe risks posed by air pollution to human health and the environment. The decision of the European legislator not to align fully with the recommendations set out in those guidelines, but instead to establish different thresholds, therefore raises important questions concerning the actual adequacy of such standards in safeguarding public health and in ensuring the attainment of the ambitious objectives set out in the European Green Deal.
