Abstract

Il presente lavoro si incentra sull’analisi del se le modalità attraverso le quali la pubblica amministrazione trae le conoscenze per addivenire ad una decisione, ovvero il potere discrezionale da questa esercitato nel corso dell’attività conoscitiva, sia in grado di raggiungere livelli ottimali di garanzia per una corretta decisione. La nota crisi del principio di legalità ha tuttavia sollevato non poche criticità in ordine al margine di valutazione, in sede di sindacato, del corretto esercizio della funzione discrezionale.  E’ noto come nel nostro ordinamento prevalga l’orientamento volto a riconoscere all’amministrazione – anziché al giudice amministrativo – una funzione sostitutiva a quella omessa dal legislatore, sul cui esercizio il giudice amministrativo stesso non deve interferire, se non negli angusti limiti della sintomatologia del vizio di eccesso di potere o in quelli meno angusti del sindacato di proporzionalità. La centralità teorica del procedimento amministrativo, come fenomeno concettualmente e giuridicamente autonomo dal diritto sostanziale, potrebbe offrire una garanzia di miglioramento dello standard di correttezza delle determinazioni amministrative.

The epistemic function of the procedure and the guarantee of correctness of administrative decisions

The paper analyzes the ways in which the public administration acquires the knowledge to take a decision, that is to say the discretionary power exercised in the course of its cognitive activity, achieving optimal levels of guarantee for a correct decision. However, the well-known crisis of the principle of legality has raised a number of critical issues with regard to the margin of appreciation, during the judicial review, of the proper exercise of the discretionary power. In our legal system prevails the orientation of giving to the administration – rather than the administrative court – a substitute function to that omitted by the legislature, over which the administrative court itself should not interfere, if not within the narrow limits of the symptomatology of the vice of excess of power or in those less narrow than proportionality review. The theoretical centrality of the administrative procedure, as a phenomenon that is conceptually and legally autonomous from the substantive law, could offer a guarantee of improvement of the standard of correctness of the administrative decisions.
