Abstract
Il contributo analizza lo statuto giuridico degli embrioni sovrannumerari, indagando la complessa intersezione tra la tutela della dignità umana, il diritto alla salute e la libertà di ricerca scientifica. Muovendo dall’esame della legge n. 40/2004 e della sua evoluzione giurisprudenziale, il lavoro evidenzia il progressivo superamento dei divieti assoluti di crioconservazione a favore di un bilanciamento basato sulla valutazione del caso concreto. L’indagine approfondisce la tensione tra la protezione della vita nascente e l’esigenza di progresso biotecnologico, soffermandosi sulla qualificazione dell’embrione quale entità intermedia tra soggettività e indisponibilità del corpo. Lo studio propone di andare oltre i rigidi automatismi normativi di carattere astratto, introducendo una distinzione tecnico-scientifica tra embrioni vitali e non vitali, in linea con i canoni di ragionevolezza e proporzionalità garantiti dall’art. 3 della Costituzione.
This paper analyzes the legal status of supernumerary embryos, investigating the complex intersection between the protection of human dignity, the right to health, and the freedom of scientific research. Drawing on an examination of Law No. 40/2004 and its jurisprudential evolution, the study highlights the progressive overcoming of the absolute prohibitions on cryopreservation in favor of a balancing approach based on case-bycase assessment. The investigation delves into the tension between the protection of nascent life and the need for biotechnological progress, focusing on the qualification of the embryo as an intermediate entity between legal subjectivity and the non-disposability of the human body. The study proposes moving beyond rigid, abstract normative automatisms by introducing a technical-scientific distinction between viable and non-viable embryos, in accordance with the standards of reasonableness and proportionality guaranteed by Article 3 of the Constitution.
