Abstract

L’articolo affronta la natura e le funzioni dei decreti legislativi attuativi dei cosiddetti “Statuti speciali”, considerati uno degli aspetti più caratteristici del “regionalismo speciale” in Italia. Ha preso in esame la giurisprudenza della Corte Costituzionale, le cui pronunce sono interpretate come una possibilità di ripensare il rapporto tra lo statuto speciale e le disposizioni che mirano ad attuarlo.

Some reflections on the legislative decrees implementing the so-called “Statuti speciali” of the Italian Autonomous Regions

The article deals with the nature and functions of the legislative decrees implementing the so-called “Statuti speciali”, considered as one of the most characteristic aspects of “special regionalism” in Italy. It considered the jurisprudence of the Constitutional Court, whose rulings are interpreted as offering the possibility of rethinking the relationship between the special statute and the provisions that seek to implement it.
